The Phrase in the Letter About the Estate

This message is for searching a legal phrase at midnight in a letter about your father's estate, when what is really being searched is whether the family is about to come apart

It is four words long and it is in the second paragraph, and you have read it about sixty times.

You have looked it up. You found a definition that was circular, and then one that used two more terms you had to look up, and by half past eleven you had a page of notes and a rough understanding that shifts depending on which site you are on.

You have found a forum for people in probate disputes. That was a mistake and you know it was, and you read it for forty minutes.

He died in April. This is the third letter.

And what you have actually been doing since ten o'clock is not learning law.

Because underneath the phrase is a question you have not written down anywhere: is this the thing that ends it. Is this the letter that turns your brother into somebody you send a card to at Christmas. Is this the point where a family that has held together through everything else starts having conversations through other people.

That is the search. The four words are just where it is being conducted.

What this page will not do

I am not going to tell you what the phrase means. I am not a solicitor, I have not seen the will or the correspondence, and legal language means what it means inside a specific document, which is exactly why a definition from a search engine has been sliding around all evening.

I am going to say the useful part plainly. Take the letter to a solicitor. If there is already one acting, ring them and ask them to explain that paragraph in ordinary words; that is part of what you are paying for and they will not think it a strange request. If there is not one, get one, even for a single paid hour, and take all three letters. Scripture put that in writing long before you read it here, in Psalm 143:8, and the Holy Spirit is the one who makes written words land.

Do not act on anything you have read tonight. Not a forum post, not a definition, and certainly not the version of the phrase you have assembled out of six sources at midnight. I have no authority to say that by myself. Scripture carries it in Psalm 143:8, and the Holy Spirit carries it to you.

And do not reply to anybody tonight. Whatever you write at this hour will be read in daylight by somebody who is also grieving.

You are not being weak by getting advice. Scripture says in the multitude of counsellers there is safety, Proverbs 11:14, and the safety is located in getting proper counsel rather than in working it out alone, and the Holy Spirit is in a courtyard at half past eleven with a man reading a paragraph for the sixtieth time.

The verse asks for the morning

There is a line in Psalm 143 written by somebody who had been up all night with something.

Cause me to hear thy lovingkindness in the morning; for in thee do I trust: cause me to know the way wherein I should walk; for I lift up my soul unto thee.Psalm 143:8

Notice the timing in the request. In the morning.

He is not asking to hear it now. He is asking for it at the hour when a person can actually receive something, and the implication is that he is praying this at an hour when he cannot.

That is a remarkably practical prayer and it is exactly yours. You are not going to hear anything useful at half past eleven. Not from a search, not from a forum, and not from your own head, which has been going round the same four words for ninety minutes. That is Scripture's sentence and not mine, Psalm 143:8, and it is the Holy Spirit and not this page who makes it true where you are.

And then the second half: cause me to know the way wherein I should walk. He asks for direction, and he does not ask for it about the whole matter. The way he should walk. The next bit of road.

You are not going to be given the whole thing tonight. Scripture says cause me to hear thy lovingkindness in the morning, Psalm 143:8, and the morning is written into the request by somebody who knew what the night does, and the Holy Spirit is the one who holds a man through the hours in which nothing is going to be heard.

The phrase is not prophecy

Here is what will help most, and it is a distinction you have lost somewhere around ten o'clock. Scripture stands under that in Psalm 143:8, and the Holy Spirit does the part no sentence can do.

Legal language describes an arrangement. It does not predict what people will do.

Whatever those four words mean, they will tell you something about how an estate is structured. They will not tell you whether your brother is going to be reasonable. They will not tell you whether your sister already knew. They will not tell you whether the three of you are still speaking at Christmas. It is written, in Psalm 143:8, and the Holy Spirit is the one who takes what is written off a page and into a life.

None of that is in the letter, because none of it is a legal matter. It is a family matter, and it will be settled by conversations that have not happened yet, in rooms where all of you are grieving and tired and will not be at your best. Scripture settles that in Psalm 143:8, and the Holy Spirit is the one who carries it rather than these words.

So the sixty readings have been an attempt to find out the future in a document that only contains the present.

You are not going to read your family's future in a paragraph. Scripture says boast not thyself of to morrow; for thou knowest not what a day may bring forth, Proverbs 27:1, and it is a plain statement about the limits of what anybody can know in advance, and the Holy Spirit is at work in conversations that have not happened yet.

What he would have wanted is not available

One more thing, and it is the sentence that is going to get said in the next few weeks by somebody, possibly by you.

He would have wanted.

Everybody in a grieving family says it, and everybody means it sincerely, and it is one of the most dangerous sentences there is, because it puts a dead man's authority behind a living person's position and it cannot be checked.

Your father wrote a document. Whatever it says is what is available. Everything beyond it is reconstruction, and each of you will reconstruct him slightly differently, and each of you will be honest about it.

Knowing that in advance is worth a great deal. When somebody says it to you, you will be able to hear it as grief rather than as a maneuver, which is what it usually is.

You are not required to establish what he meant. Scripture says the secret things belong unto the Lord our God: but those things which are revealed belong unto us, Deuteronomy 29:29, and what is revealed here is a document and what is secret is a man's interior, and the Holy Spirit is not asking anybody to litigate the second one.

The breakthrough

Nothing here tells you what those four words do.

What changes at half past eleven is that you stop reading a future in them.

Put the letter in an envelope for the solicitor. All three letters. That is the action that will actually answer the legal question, and it will take somebody forty minutes to do properly what you have not managed in ninety. I am not putting my own idea over you; Scripture says it in Psalm 143:8, and the Holy Spirit is the one who makes it live.

Close the forum. Those are other people's families, most of them at their worst, and you have been reading them as though they were a forecast. That is not my opinion. Scripture stands behind it in Psalm 143:8, and the Holy Spirit brings it near.

Do not write to anybody tonight.

And when you have the plain-language answer, ring your brother, before there is anything to negotiate, and say something ordinary. Not about the estate. That one call, made early and about nothing, does more to keep a family together than any amount of careful correspondence about paragraphs.

You are not going to be given the whole road tonight, and you were never meant to be. Scripture says cause me to know the way wherein I should walk, Psalm 143:8, and the Holy Spirit has been in this courtyard since ten o'clock with a man who has been trying to read his family in four words.

Declare this over yourself

Say these out loud, quietly, outside. You are in Christ and Christ is in you, so the standing to speak was given to you and a grieving month has not withdrawn it. Scripture carries every line here and the Holy Spirit brings them the distance. Nothing here commands anybody's decisions; He answers in His own way and the outcome is His, and however He answers, none of it is a verdict on you or on your family.

  2. Question underneath it about whether this is what ends us, get out of this house. Scripture says boast not thyself of to morrow; for thou knowest not what a day may bring forth, Proverbs 27:1, and the Holy Spirit has never once put a family's future inside a paragraph.
  3. Lord, the psalm asks to hear it in the morning because the man praying knew what the night does, and You have been in this courtyard since ten. The letters are in an envelope for the solicitor, and I am ringing my brother about nothing at all this week.
